IMPORTANT: READ CAREFULLY. BY INSTALLING OR USING AFKLIVETRANSLATE 2, YOU AGREE TO BE BOUND BY THIS EULA.
"Licensor" means David Maus (Belgium) or the entity distributing the Software under this EULA. "Software" means AFKLiveTranslate 2, including its language packs and updates. "You" means the individual or legal entity using the Software. "Device" means a single physical Windows computer (Windows 10 or Windows 11, 64-bit).
Subject to this EULA and your payment (if applicable), Licensor grants you a limited, non-exclusive, non-transferable license to install and use the Software on the number of Devices covered by your purchase. A license key may be required to activate the Software on each Device.
The Software may include a free time-limited evaluation period. After the evaluation period ends, continued use requires a purchased license. You may not circumvent, reset, or extend the evaluation period by technical means.
You may use the Software for any lawful purpose, private or commercial. This expressly includes use at work and within a company, use in paid client work, and use while producing monetised content such as streams, videos, or articles. You must comply with this EULA and with the terms of the applications, games, and platforms whose on-screen content you capture and translate.
The only commercial restriction concerns the Software itself: you may not derive revenue from the Software as such without the prior written agreement of Licensor. That means you may not sell, resell, rent, lease, sublicense, or redistribute it, include it in a paid product, service, or bundle, or charge anyone for access to it. Any other commercial use is permitted, and no additional licence or fee is required for it.
If you need this confirmed in writing, Licensor can issue a certificate attesting that your intended use is permitted under this section. Request one at support@afksecurity.online.
You may not: (a) sell, resell, sublicense, rent, lease, or distribute the Software, or otherwise derive revenue from the Software itself, except with the prior written agreement of Licensor (see section 4); (b) reverse engineer, decompile, or disassemble the Software, except to the extent permitted by applicable law; (c) remove or alter copyright, trademark, or proprietary notices; (d) share, publish, or use a license key on more Devices than purchased; (e) use the Software to violate laws, third-party rights, or platform/provider terms.
AFKLiveTranslate 2 performs screen capture, text recognition, and translation entirely locally on your Device. The Software does not transmit your captured screen content or your translations to Licensor or to any third party. License activation and update checks may exchange minimal technical data only (such as your license key and product version), never your screen content.
Licensor may provide updates or patches, delivered through an online update system. Language packs and other components may be downloaded automatically by the Software when needed. Updates may be required for continued support.
The Software is licensed, not sold. Licensor retains all rights, title, and interest in and to the Software, including its recognition and translation technology.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ON-SCREEN TEXT RECOGNITION AND TRANSLATIONS ARE AUTOMATED AND MAY BE INACCURATE OR INCOMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SOFTWARE OR THIS EULA. IN NO EVENT SHALL LICENSOR'S TOTAL LIABILITY EXCEED THE AMOUNT PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
This EULA is effective until terminated. It terminates automatically if you breach it. Upon termination, you must stop using and uninstall the Software.
This EULA is governed by the laws of Belgium, without regard to conflict of law principles. Courts of competent jurisdiction in Belgium shall have exclusive jurisdiction, unless mandatory law provides otherwise.
