AFKLIVETRANSLATE 2 - END USER LICENSE AGREEMENT (EULA) Version 1.0 IMPORTANT: READ CAREFULLY. BY INSTALLING OR USING AFKLIVETRANSLATE 2, YOU AGREE TO BE BOUND BY THIS EULA. 1. DEFINITIONS "Licensor" means David Maus (Belgium) or the entity distributing the Software under this EULA. "Software" means AFKLiveTranslate 2, including its language packs and updates. "You" means the individual or legal entity using the Software. "Device" means a single physical Windows computer (Windows 10 or Windows 11, 64-bit). 2. LICENSE GRANT Subject to this EULA and your payment (if applicable), Licensor grants you a limited, non-exclusive, non-transferable license to install and use the Software on the number of Devices covered by your purchase. A license key may be required to activate the Software on each Device. 3. EVALUATION (TRIAL) The Software may include a free time-limited evaluation period. After the evaluation period ends, continued use requires a purchased license. You may not circumvent, reset, or extend the evaluation period by technical means. 4. PERMITTED USE You may use the Software for personal or internal business purposes, provided you comply with this EULA and with the terms of the applications, games, and platforms whose on-screen content you capture and translate. 5. RESTRICTIONS You may not: (a) sell, sublicense, rent, lease, or distribute the Software except as expressly permitted by Licensor; (b) reverse engineer, decompile, or disassemble the Software, except to the extent permitted by applicable law; (c) remove or alter copyright, trademark, or proprietary notices; (d) share, publish, or use a license key on more Devices than purchased; (e) use the Software to violate laws, third-party rights, or platform/provider terms. 6. LOCAL PROCESSING AND PRIVACY AFKLiveTranslate 2 performs screen capture, text recognition, and translation entirely locally on your Device. The Software does not transmit your captured screen content or your translations to Licensor or to any third party. License activation and update checks may exchange minimal technical data only (such as your license key and product version), never your screen content. 7. UPDATES AND LANGUAGE PACKS Licensor may provide updates or patches, delivered through an online update system. Language packs and other components may be downloaded automatically by the Software when needed. Updates may be required for continued support. 8. INTELLECTUAL PROPERTY The Software is licensed, not sold. Licensor retains all rights, title, and interest in and to the Software, including its recognition and translation technology. 9. DISCLAIMER OF WARRANTIES THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ON-SCREEN TEXT RECOGNITION AND TRANSLATIONS ARE AUTOMATED AND MAY BE INACCURATE OR INCOMPLETE. 10. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SOFTWARE OR THIS EULA. IN NO EVENT SHALL LICENSOR'S TOTAL LIABILITY EXCEED THE AMOUNT PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. 11. TERMINATION This EULA is effective until terminated. It terminates automatically if you breach it. Upon termination, you must stop using and uninstall the Software. 12. GOVERNING LAW This EULA is governed by the laws of Belgium, without regard to conflict of law principles.
